These Terms of Service (“Terms”) govern your use of dekedata.com, the Deke Data membership platform, and any related services provided by Deke Data (“we,” “us,” or “our”).
By accessing or using our website or services, you agree to be bound by these Terms and comply with all applicable laws and regulations. If you do not agree, you may not use our website or services.

We reserve the right to update or modify these Terms at any time, and changes take effect immediately upon posting on this page.

1. Limitations of Use

By accessing this website and platform, you agree that you will not:

  1. Modify, copy, create derivative works of, decompile, or reverse-engineer any part of the site or services.

  2. Remove copyright or proprietary notices from materials on the website.

  3. Transfer website materials to another person or “mirror” them on any other server.

  4. Use the website or services in any manner that interferes with their operation or our networks.

  5. Transmit any unlawful, harassing, obscene, fraudulent, or harmful material.

  6. Violate any applicable laws or regulations.

  7. Use the website to send unauthorized advertising or spam.

2. Prohibited Use of Data (Anti-Scraping & AI Model Protection)

To protect Deke Data’s proprietary analytics and player information, you agree that you will not:

  • Scrape, extract, spider, copy, bulk-download, or otherwise harvest data from Deke Data.

  • Use automated tools or scripts to access the platform.

  • Redistribute, publish, or resell data from our platform.

  • Use Deke Data content for training machine learning models or datasets without written permission.

  • Recreate, replicate, or imitate our predictive analytics, prospect scores, or player comparison tools based on the platform’s data.

Violations may result in immediate account termination and legal action.

3. Intellectual Property

All materials, branding, analytics, prospect scores, predictions, and software on this website are owned by or licensed to Deke Data and protected by copyright and trademark laws.

A limited license is granted to download one copy of materials for personal, non-commercial, transitory use. This is a license, not a transfer of ownership.

This license automatically terminates if you violate these Terms or if Deke Data terminates your access.

4. User-Generated Content

Users may submit player information, corrections, or photos.

Your Rights

You retain ownership of any intellectual property you upload or submit.

License You Grant Us

By submitting content, you grant Deke Data a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to:

  • Use

  • Store

  • Modify

  • Display

  • Process

  • Create derivative works (e.g., updated profiles or analytics)

This license supports the normal functioning of the platform and is consistent with our Privacy Policy.

You may delete your submissions at any time, but historical use (such as data used in analytics) may persist.

Player Photos and Profile Updates

Content submitted for player profiles may be:

  • Displayed within Deke Data for subscribed users,

  • Used to update player records, and

  • Included in analytics calculations.

We will not publicly distribute player photos outside the platform without consent.

5. Minor Data & Parent/Guardian Responsibility

Some player information relates to individuals under 18.

By uploading or submitting any content relating to a minor, you represent and warrant that:

  • You are the parent or legal guardian of the minor OR

  • You have legal authority to submit such data.

You agree not to upload data about a minor without proper authority.

6. Predictions & Analytics Disclaimer

Deke Data provides player projections, draft probabilities, prospect scores, comparisons, and other analytics derived from proprietary modeling.

You acknowledge that:

  • All projections are estimates only,

  • They may be inaccurate or incomplete,

  • They do not guarantee future athletic performance, draft outcomes, or player advancement.

Deke Data is not responsible for decisions made based on analytics or predictions.

7. Memberships, Billing & Refunds

Some features of Deke Data require a paid membership or subscription.

By subscribing, you authorize us—or our payment provider (e.g., Stripe)—to charge your payment method on a recurring basis until cancelled.

Unless otherwise stated:

  • All subscription fees are non-refundable.

  • Partial billing periods are not prorated.

  • You may cancel at any time, but cancellations take effect at the end of the current billing cycle.

Deke Data may refuse service, suspend accounts, or terminate access for misuse or non-compliance with these Terms.

8. Liability

Our website and platform are provided “as is.” To the fullest extent permitted by law, Deke Data disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Deke Data and its suppliers will not be liable for any consequential, indirect, incidental, or special damages, including:

  • Lost profits

  • Lost data

  • Lost business

  • Loss of reputation

  • Loss of opportunity

Some jurisdictions do not allow certain limitations, so these may not apply to you.

9. Accuracy of Materials

Materials on Deke Data may not be complete or up-to-date. We do not guarantee the accuracy or reliability of any information, including player data, statistics, or projections.

We reserve the right to update content at any time.

10. Links to External Sites

Deke Data is not responsible for the content of external sites linked on our platform. Use of third-party websites is at your own risk.

11. Account Termination

We may terminate or suspend your access immediately, with or without notice, if:

  • You violate these Terms,

  • Engage in scraping or redistribution,

  • Misuse proprietary analytics,

  • Submit unauthorized or harmful content,

  • Abuse the platform.

12. Severability
If any part of these Terms is found invalid or unenforceable, the remainder will continue in effect.
13. Governing Law

These Terms are governed by the laws of Washington, USA, and you agree to the exclusive jurisdiction of Washington’s courts.
